Ex parte mediation is a non-traditional mediation process developed/created by Judge Cudmore while serving on the Federal bench. Instead of meeting with Judge Cudmore as mediator for a day of mediation, the parties work ex parte and independently with Judge Cudmore via telephone and email. The success ratio for Judge Cudmore's ex parte mediation has approached 90% over the past decade. During the inital telephone conference to schedule a mediation, Judge Cudmore will recommend ex parte mediation in the appropriate case. If the parties all agree ex parte mediation will commence. Confidential mediation statements will be submitted by a date certain. Thereafter, Judge Cudmore will work independently with each party to move the mediation to closure.
